Wishary — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Wishary — the mobile and web application, the website at https://wishary.app, and all related services (together, the “Service”). The Service is operated by the Wishary team (the operator of the Service — “we”, “us”, “the Operator”), contact: hello@wishary.app.

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by them. If you do not agree, do not use the Service.

1. Acceptance of the Terms

1.1. By accessing or using the Service in any way — including the web app at https://wishary.app/app/, the Android application (downloaded from Google Play or as a direct APK from https://wishary.app/downloads/wishary.apk), or the iOS application from the App Store — you accept these Terms and our Privacy Policy, which is incorporated by reference.

1.2. If you use the Service on behalf of a child as part of a Family room (see Section 3), you accept these Terms on the child's behalf and are responsible for the child's use of the Service.

1.3. If you obtain the app through an app store (Google Play, Apple App Store), the store's own terms also apply to the download and any in-app purchases. In case of conflict regarding billing, the store's terms govern billing; these Terms govern everything else.

2. What Wishary Is

2.1. Wishary is a gamification app for everyday chores, agreements, and shared wishes. Users create private rooms in one of several modes — Solo (personal productivity), Duo (couples), Group (friends), and Family (with parent and child roles) — joined by invite code.

2.2. Inside a room, participants create and complete tasks, earn coins (an in-app virtual currency), and spend coins on coupons — wishes, favors, promises, and rewards created by room members for each other.

2.3. Coins and coupons are virtual items. Coins are a fictional, in-game currency with no monetary value. They are not money, electronic money, a payment instrument, a security, or property of any kind. Coins and coupons cannot be redeemed, exchanged, or cashed out for real money or anything of monetary value outside the Service, and may not be sold, transferred, or traded outside the Service. See Section 6.

2.4. Coupons represent informal promises between room members (e.g., “breakfast in bed”, “movie night”). We are not a party to these promises and do not guarantee, enforce, or mediate their fulfillment. Whether a coupon is honored is entirely between the participants.

2.5. The Service is currently in active development (beta). Features, limits, and availability may change. See Section 8.

3. Accounts and Eligibility

3.1. Age. You must be at least 13 years old to create your own Wishary account. Persons under 13 may use the Service only as a child member of a Family room, under the supervision and with the consent of a parent or legal guardian who manages the room and accepts these Terms on the child's behalf.

3.2. One account per person. You may register and maintain only one account. You must provide accurate information and keep it up to date.

3.3. Sign-in. Accounts are created with an email address or Google Sign-In. You are responsible for safeguarding access to your account and for all activity that occurs under it. Notify us at hello@wishary.app if you suspect unauthorized use.

3.4. Account deletion. You may request deletion of your account at any time — via the in-app account deletion option or by emailing hello@wishary.app from the email address associated with your account. Deletion removes your account and associated personal data as described in the Privacy Policy; some room records (e.g., completed shared tasks affecting other users' balances) may be retained in anonymized form to keep other users' data consistent.

4. User Content

4.1. “User Content” means anything you create or upload in the Service: task and coupon titles and descriptions, chat messages, photos attached to tasks and coupons, avatars, room names, custom templates, and similar material.

4.2. You own your User Content. You retain all rights to it.

4.3. License to us. So that the Service can function, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, and display your User Content solely for the purpose of operating and providing the Service — for example, showing your task photo to the other members of your room and storing it on our hosting infrastructure. This license ends when you delete the content or your account, except to the extent the content has been shared with other room members and persists in their rooms, or where retention is required by law.

4.4. Visibility. User Content is visible only to members of the room in which it was posted. Rooms are private; we do not publish room content.

4.5. Your responsibility. You are solely responsible for your User Content. You represent that you have all rights necessary to post it and that it does not violate any law or third-party right.

5. Acceptable Use

5.1. You agree not to:

• post content that is illegal, threatening, harassing, defamatory, hateful, pornographic, exploitative of minors, or that promotes violence or discrimination;

• harass, bully, intimidate, or abuse other users, in chat or through tasks/coupons;

• infringe anyone's intellectual property, privacy, or other rights;

• impersonate any person or misrepresent your affiliation;

• use the Service for unsolicited advertising, spam, or any commercial resale;

• attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure; probe, scan, or test vulnerabilities except with our prior written consent;

• interfere with the Service's operation, including through automated bulk requests, scraping, or abuse of synchronization mechanisms;

• exploit bugs in the virtual economy (e.g., duplication of coins) — discovered bugs should be reported to hello@wishary.app;

• use the Service in connection with any real-money gambling, wagering, or financial scheme.

5.2. Room administration. Room owners and administrators may remove (kick) members from their rooms, manage room settings, and — in Family rooms — supervise child accounts. A removed user cannot rejoin the room. Room-level moderation is the room admin's responsibility; we may, but are not obligated to, review room content.

5.3. Enforcement. We may remove content, restrict features, reset virtual balances, suspend, or terminate accounts that violate these Terms (see Sections 6 and 9).

6. Virtual Economy Rules

6.1. No monetary value. Coins, coupons, balances, statistics, leaderboard positions, welcome bonuses, and any other in-app items or numbers (collectively, “Virtual Items”) have no monetary value and exist only as features of the Service.

6.2. No redemption, no refunds. Virtual Items cannot be exchanged for real money, goods, or services outside the Service. We do not buy back, refund, or compensate Virtual Items in any form, including when they are lost due to your actions, another room member's actions (e.g., a coupon being cancelled), account termination, or changes to or discontinuation of the Service.

6.3. Limited license, not property. Virtual Items are licensed to you for use within the Service, not sold. You receive a limited, revocable, non-transferable license to use them inside your rooms. You may not sell, trade, or transfer Virtual Items outside the Service or for anything of real-world value.

6.4. Adjustments and resets. We may modify the virtual economy (e.g., rewards, prices, limits, escrow mechanics) at any time. We may adjust, freeze, or reset balances and Virtual Items where we reasonably believe they were obtained through abuse, fraud, bug exploitation, or violation of these Terms.

6.5. In-room mechanics. Coin transfers between users (e.g., buying another member's coupon) may be held in escrow until the coupon is used; shared coupons are funded by member contributions and refunded in coins if cancelled. These mechanics operate automatically within the Service and involve no real money.

7. Premium Subscriptions

7.1. Free tier and Premium. The free tier currently includes 1 room per user and up to 15 active tasks and 15 active coupons per room. Premium includes up to 10 rooms, custom photos on tasks and coupons, custom avatars, and custom templates. Exact features and limits of each tier may change and are described in the app at the point of purchase.

7.2. Billing. Premium is sold as an auto-renewing subscription billed through the platform you use — Google Play or the Apple App Store — with subscription state managed via RevenueCat. We do not collect or store your card details; payment is handled entirely by the app store.

7.3. Auto-renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends (or as otherwise specified by the store). The store charges your payment method at renewal.

7.4. Cancellation. You can cancel at any time in your app store subscription settings (Google Play subscriptions / Apple ID subscriptions). Cancellation stops future renewals; you keep Premium until the end of the already-paid period. Deleting the app does not cancel a subscription.

7.5. Refunds. Refunds for subscription payments are governed by the refund policy of the app store through which you purchased (Google Play or Apple). We cannot issue refunds for purchases made through app stores; please direct refund requests to the relevant store. Where required by applicable consumer protection law, statutory refund rights remain unaffected.

7.6. Price changes. Subscription prices may change. The store will notify you of price changes per its rules, and changes apply no earlier than your next billing period.

7.7. Downgrade effects. If a subscription ends, content created with Premium features remains, but Premium-only capabilities (e.g., extra rooms beyond the free limit, adding new custom photos/templates) become unavailable until you re-subscribe. Rooms above the free limit may become read-only or inaccessible rather than deleted.

8. Service Availability; Beta Status; No Warranty

8.1. The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

8.2. Wishary is an early-stage product built and operated by the Wishary team. We do not guarantee uninterrupted or error-free operation, data preservation, or the availability of any particular feature. We may add, change, suspend, or discontinue features (including the virtual economy, room modes, limits, or platform availability) at any time.

8.3. We may suspend the Service in whole or in part for maintenance, security, or technical reasons. If we decide to discontinue the Service entirely, we will make reasonable efforts to give advance notice via the app or the website.

8.4. Parts of the Service depend on third-party infrastructure (hosting, push notification delivery, app stores, sign-in providers). We are not responsible for failures of such third-party services.

9. Suspension and Termination

9.1. By you. You may stop using the Service at any time and may delete your account as described in Section 3.4.

9.2. By us. We may suspend or terminate your access to the Service, with or without notice, if you materially or repeatedly violate these Terms, create risk or legal exposure for us or other users, or if we discontinue the Service. Where reasonable, we will warn you before terminating for a fixable violation.

9.3. Effect. Upon termination, your license to use the Service ends and your Virtual Items lapse without compensation (Section 6). Sections that by their nature should survive (including 4.3 in part, 6, 10, 11, and 13) survive termination. If you have an active paid subscription and we terminate the Service without cause attributable to you, refunds for the unused period are handled per the relevant app store's policy and applicable law.

10. Limitation of Liability

10.1. To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or Virtual Items, arising out of or related to your use of (or inability to use) the Service.

10.2. To the maximum extent permitted by applicable law, the Operator's total aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the amounts you paid us for the Service in the 12 months preceding the claim, or (b) EUR 50.

10.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, for death or personal injury caused by negligence, or your mandatory rights as a consumer.

10.4. User interactions. We are not responsible for the conduct of users, for the content of rooms you join, or for the fulfillment of any promise represented by a coupon. Disputes between room members are between those members.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold the Operator harmless from third-party claims, damages, and reasonable expenses (including legal fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right in connection with the Service. This clause does not apply to consumers where prohibited by mandatory consumer law.

12. Governing Law and Disputes

12.1. These Terms are governed by the laws of the Operator's place of residence or business (to be specified as the operating entity is formalized), excluding its conflict-of-law rules.

12.2. Disputes shall be resolved by the competent courts of that jurisdiction, unless mandatory consumer protection law gives you the right to sue or be sued elsewhere (e.g., in your country of residence in the EU).

12.3. Nothing in this section deprives you of protections granted by mandatory law of the country where you habitually reside.

13. Changes to These Terms

13.1. We may update these Terms from time to time — for example, when adding features, changing subscription tiers, or changing service providers. The “Last updated” date at the top reflects the latest version.

13.2. For material changes we will give notice in the app or by email at least 14 days before the changes take effect, where reasonably possible. Continued use of the Service after the effective date constitutes acceptance. If you do not agree, stop using the Service and delete your account.

14. Miscellaneous

14.1. Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and the Operator regarding the Service.

14.2. Severability. If any provision is held invalid, the remaining provisions remain in effect.

14.3. No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.

14.4. Assignment. You may not assign these Terms. We may assign them in connection with a transfer of the Service (e.g., to a company formed to operate Wishary), with notice to you.

14.5. Language. These Terms may be published in multiple languages. The English version prevails in case of any discrepancy.
